Terms & Conditions

These terms apply to all equipment hire agreements with Cape Party Hire. By confirming an enquiry you accept them in full.

1. Definitions and agreement

"The Company" means Cape Party Hire. "The Hirer" means the person or entity named on the booking confirmation. "Equipment" means all goods listed on the confirmed hire quotation, including accessories, cables, containers and packaging.

Submitting an enquiry does not constitute a booking. A booking exists only once the Company issues a written confirmation and the required deposit has been received. All bookings remain subject to equipment availability.

2. Hire period and rates

Hire rates are quoted per 24-hour day unless otherwise stated in writing. The hire period begins at the time of delivery or collection by the Hirer and ends at the agreed return time.

Equipment retained beyond the agreed return time is charged at the full daily rate for each additional day or part thereof, unless an extension has been agreed in writing.

3. Liability during the hire period

Risk in the Equipment passes to the Hirer on delivery and remains with the Hirer until the Equipment is collected by, or returned to, the Company. Ownership at all times remains with the Company.

The Hirer is responsible for the safe and correct operation of all Equipment, for supervising its use, and for ensuring that only competent adults operate heating, frying or electrical equipment. Equipment must not be sub-hired, moved off the delivery address, or modified.

The Company is not liable for any injury, loss, damage or consequential loss arising from the use or misuse of hired Equipment, save where such liability cannot lawfully be excluded. The Hirer indemnifies the Company against third-party claims arising from the Hirer's use of the Equipment.

4. Damage deposits, loss and cleaning

A refundable security deposit is payable before or on delivery. The deposit starts at R900. The final deposit amount is not calculated automatically: it is confirmed manually by the Company after review of the Hirer's specific event requirements, and is communicated in writing before the booking is confirmed.

The deposit is refunded in full within seven (7) business days of collection, provided the Equipment is returned complete, undamaged and reasonably clean.

The Company may deduct from the deposit the cost of repairing damage, replacing lost or stolen items at current replacement value, professional cleaning where equipment is returned soiled (including oil, sugar residue or food waste), and any outstanding hire charges. Where the cost exceeds the deposit, the balance remains payable by the Hirer on demand.

Fair wear and tear is excluded from deductions. Damage caused by incorrect voltage, unattended operation, exposure to rain, or transport by the Hirer is not fair wear and tear.

5. Cancellations and weather

Cancellations made more than seven (7) days before the event date receive a full refund of amounts paid, less any bank charges. Cancellations between seven (7) and two (2) days before the event forfeit fifty percent (50%) of the hire fee. Cancellations within forty-eight (48) hours of the event forfeit the full hire fee.

Outdoor hires are weather-dependent. Where the South African Weather Service issues a severe weather warning for the event area, the Hirer may postpone to an alternative date within ninety (90) days at no additional charge, subject to availability, provided notice is given no later than 12h00 on the day before delivery.

The Company reserves the right to withhold delivery or set-up of electrical Equipment where wet or unsafe conditions exist on site. In such cases the hire fee for the affected items is credited toward a future booking.

6. Delivery, access and site boundaries

Delivery and collection are quoted to a ground-floor point that is safely accessible by a light delivery vehicle within twenty (20) metres of a hard-surfaced parking area. The Hirer must ensure clear, safe and lawful access at the agreed times.

The Company's crew will not carry Equipment up unlit stairways, across soft sand or unstable ground, through private property without permission, or into areas where the crew's safety cannot be reasonably assured. Additional handling requirements (stairs, lifts, long carries, beach or mountain venues) must be disclosed at enquiry stage and may attract a surcharge.

Where delivery cannot be completed due to inaccessible premises, absent representatives or an unsafe site, a failed-delivery fee equal to the delivery charge applies and the hire fee remains payable.

The Hirer must provide a suitable, earthed power supply for all electrical Equipment. Generators supplied by third parties must be rated for the load of the Equipment hired.

7. Return of equipment

All Equipment must be available for collection at the agreed time, switched off, cooled down and packed in the containers supplied. Fryer oil must be allowed to cool and must not be disposed of into drains.

Any shortage or damage noted at collection will be recorded and communicated to the Hirer in writing within two (2) business days.

8. Payment, privacy and governing law

Unless credit terms have been agreed in writing, full payment is due before delivery. The Company processes personal information supplied through this website solely to quote, deliver and administer hires, in line with the Protection of Personal Information Act, 2013.

These terms are governed by the laws of the Republic of South Africa and are subject to the jurisdiction of the Magistrates' Court of Cape Town.
